The singer's lawyer Leah Godesky submitted a new filing to a New York judge on Tuesday,which was obtained by Rolling Stone, expressing concern that the trial could be jeopardized if Kesha's two pending appeals are left unresolved.
'Kesha has an overwhelming interest in having the trial proceed as scheduled on February 20, 2023, not only so that she can seek vindication but also so that she can get this ordeal behind her and move on with her life,' penned Godesky.

Kesha's attorney said that the Tik Tok hitmaker is 'eager' to face off with her former collaborator in court next year and has been actively seeking to 'expedite proceedings in the Court of Appeals.'
Kesha's attempts to speedup briefing deadlines, so that oral arguments in both appeals could be heard in either October or November of this year, have been rejected by Dr. Luke and his legal team.

'It would be a monumental waste of party and judicial resources to proceed to trial when there is a very real risk that a new trial immediately would be required, as would be the case if the Court of Appeals reverses as to any of the several questions currently before it.
'Promptly resolving the pending appeals is essential before trial can begin.'
One of Kesha's pending appeals pertains to a prior ruling that Dr. Luke is considered a private, not public, figure.
This means that he and his legal team will only need to prove that Kesha acted with negligence, but not actual malice, when she made her misconduct accusations.
Her second appeal is regarding the appellate court's ruling earlier this year that she could not go after Luke (real name Lukasz Sebastian Gottwald) for her legal fees.

Kesha was granted a request from a judge in late June 2021, which allowed her to retroactively apply a New York free speech law to have Dr. Luke pay her legal fees, though he appealed that ruling a month later.
The New York free speech law was passed in an effort to curb lawsuits filed by the rich and powerful to stifle free speech.
Manhattan Supreme Court Justice Jennifer Schecter agreed that the New York law could be applied retroactively to the Kesha and Dr. Luke lawsuit, while she also granted Kesha's request to file counterclaims against Dr. Luke, and would make Dr. Luke responsible for her legal fees, if she should win the defamation lawsuit.
The producer appealed the ruling in July, with a judge siding with him in his ruling in March 2022.
The judge stated that when the free speech law was amended in 2020, it, 'did not specify that the new legislation was to be applied retroactively.'

In a response letter issued to Rolling Stone from Dr. Luke's lawyers on Tuesday, they fired back at Kesha's claims by alleging that it is the pop star's attorneys who are responsible for the delays in court proceedings over the years.
They also made mention of the letter recently sent to the judge two weeks ago regarding their client's alleged 'willingness' to proceed but with the star's appeals still pending.
'As our own letter to the court makes clear, Dr. Luke is ready and willing to try the case in February and he looks forward to winning the trial,' the producer's team penned Tuesday.
'It is Kesha's attorneys who have delayed the case for years by endlessly filing meritless appeals, which they have lost time and again. If the case is not tried in February, it solely will be due to the fact that Kesha's lawyers decided yet again to take more appeals — this time of two decisions that once again ruled against her in the Appellate Division.'

Kesha announced in January that her Kesha Live tour would continue this spring, with dates starting in March.
She also announced a second cruise tour that was to set sail on April 1, 2022.
